When the Attorney Becomes the Defendant: The Psychology of How Ethical Lines Are Crossed

This program addresses a gap no standard ethics CLE reaches: the psychology of what happens inside the mind of an attorney in the months and years before a rule is broken. Drawing on the speaker's own federal conviction and subsequent study of attorney misconduct patterns, this program maps The Erosion Sequence™ — a five-stage framework identifying how professional identity erodes from The First Accommodation through The Normalization Window, Identity Drift, The Locked Position, and The Collapse Event — and gives attorneys the vocabulary, case studies, and stage-specific exit strategies to recognize where they are in that sequence before the window to intervene closes.

Upon completion, participants will be able to:

1)    Distinguish emotional self-regulation from ethical self-regulation and explain why emotional stability does not guarantee ethical compliance

2)    Identify the five stages of The Erosion Sequence™ and apply the appropriate exit strategy at each stage

3)    Recognize the role of identity as the primary engine of ethical drift

4)    Apply three pre-installed decision-architecture questions calibrated to specific stages of erosion

5)    Articulate why voluntary disclosure at Stage 4 produces categorically different outcomes than involuntary exposure at Stage 5.
