Keith Barkaus focuses his practice on client counseling and prosecution of U.S. and foreign patent applications in varying technology areas. Mr. Barkaus has experience in the preparation and prosecution of patent applications covering innovations including, but not limited to, electrical devices, mechanical devices, computer hardware and computer software. In addition, Mr. Barkaus has prepared patentability, validity, right to use and infringement opinions and also conducted due diligence investigations.
Mr. Barkaus also has significant litigation experience including preparing infringement and invalidity contentions, working with experts to prepare expert reports, taking and defending depositions and preparing and opposing a variety of motions. Recently, Mr. Barkaus was part of a team that successfully defended their client in a patent litigation involving four patents related to remote controls. Mr. Barkaus and the team were successful in eliminating three of the four asserted patents prior to trial and secured a jury verdict of non-infringement and invalidity with respect to the fourth after trial. Mr. Barkaus has also worked on more than a dozen Inter Partes Review proceedings before the Patent Trial and Appeal Board in which he has represented both patent owners and requesters. Prior to joining the firm, Mr. Barkaus was an associate at Ostrolenk Faber LLP and Cooper & Dunham, LLP.
