Constance  Kim, M.D.R.

Constance Kim focuses her litigation and alternative dispute resolution practice on business, employment, and intellectual property matters.  In addition to counseling clients on their compliance duties and business objectives, she is intimately involved in managing and developing their case strategies.  Ms. Kim litigates in various forums and jurisdictions throughout the United States. 

 

Some of her representative matters include: 

 

  • Dismissals of actions involving fraud, conspiracy, money laundering, RICO, and related claims; contested fees in a False Claims Act qui tam action; multi-district litigation involving spoliation of evidence and multi-party toxic tort cases; 
  • Resolution of a breach of contract case involving international security service providers to the US government; supervised team of 20 paralegals in electronic discovery review; 
  • Negotiated settlements involving a foreign offer of employment under Labor Code §970, wage and hour claims before administrative agencies, defective residential water treatment devices, packaging materials, national technical support call center, and media company; 
  • Enforcement of arbitration agreements in commercial agreements, employment agreements, and securities investments; 
  • Obtained judgment against failed investor in international polo competition; 
  • Collaborated on numerous cases involving wrongful termination, retaliation, harassment, discrimination, disability, defamation, negligent hiring, misclassification, sales commissions, and indemnification rights; conducted employment law trainings and workplace investigations; participated in mediations; 
  • Obtained ruling in favor of motion for contempt for failure to abide by injunction in trademark infringement case; worked on wheel design patent infringement case and negotiation of licensing agreement; 
  • Worked together with French colleagues on website design infringement case and compliance with French data privacy laws; conducted group presentation comparing attorney-client privilege in the US, UK and France; analyzed enforceability of confidentiality and interim awards in international arbitrations; drafted reports on director liability, litigation hold requirements, and ETSI/FRAND litigation in the US. 
  • Ms. Kim has held leadership positions in several organizations. As Chair of the International Law Section of the Los Angeles County Bar Association, she has led a delegation to the Middle East and overseen diverse programming and developing partnerships with foreign bar associations. Currently, she is Treasurer and Trustee of the Foundation Board of Trustees at the University of California, Hastings College of the Law, actively engaged in fundraising efforts and alumni outreach.
