What do you focus on?
My practice involves three main areas of focus, leveraging my experience as legal counsel for talent, celebrity estates and brands. I serve as a trusted advisor for management companies, new media and celebrity talent, advertising agencies, artists and entrepreneurs. I use my specialized knowledge of the interplay among the right of publicity, trademarks and copyrights to help clients create and protect assets while reaching wider audiences across new mediums.
Licensing and FTC Compliance
I negotiate and draft licensing agreements on behalf of licensor and licensee clients in various industries and product categories including apparel, accessories, footwear, automotive and food and beverage. I’ve represented talent in film, television and literary ventures, with increasing activity in the digital space, including multi-channel network agreements and branded entertainment deals. I ensure that collaborations between brands and talent are compliant with all applicable laws and regulations, including the Federal Trade Commission’s strict endorsement and advertising guidelines.
IP Protection and Clearance
I review and identify legal concerns in marketing materials, scripts and advertising copy, offering creative solutions to minimize legal risk without delaying or thwarting the campaign. Similarly, I provide clients with cost-effective strategies to protect their IP assets and advise on pre-litigation efforts to settle unauthorized commercial uses of their IP. I prioritize cleaning up the marketplace from such unauthorized uses to preserve the value of the brand and facilitate brand expansion.
Expert Witness Consultation
I provide litigation support services on expert witness matters involving a celebrity’s right of publicity, post-mortem right of publicity, copyrights and trademarks in areas ranging from infringement damage assessment to marital dissolution and estate taxation.
