“Is Your Voice Biometric Data? BIPA, AI and the New Era of Voiceprint Litigation” looks at a question that matters more as AI voice tools spread: when does an ordinary voice recording become a protected "voiceprint" under the Illinois Biometric Information Privacy Act?
The presentation will review BIPA's definitions of "biometric identifier" and "biometric information" and the core Section 15 obligations: written notice, written release, a publicly available retention and destruction policy, and limits on disclosure. The key cases of Rosenbach v. Six Flags and Cothron v. White Castle will be reviewed as well as current plaintiff theories about AI transcription and employee voice data. The presentation will include a practical compliance playbook covering data inventories, AI-specific consent, retention, vendor contracts and litigation readiness, plus a comparison of other state biometric and privacy laws and a look at pending legislation. Who should attend? Litigators, privacy counsel, employment counsel and in-house lawyers advising any business that uses voice-enabled technology, not only technology companies.
