This subject is a culmination of many years’ lecturing on the subject of law and medicine and how the two interact. Subjects covered include peer review; risks and complications; the value of good bedside manners; how to avoid medical malpractice; what to do about obstructive and difficult conduct; and many other areas. The course is useful not only to lawyers, but also healthcare professionals. The concept is that, except for a few physicians, much of what occurs in the law is alien to the medical profession. Likewise, lawyers have some difficulty in understanding the medical world. There is an intersection between these two fields based upon the requirement to work together on behalf of patients, medicine and the legal system. This seminar is intended to explore some of those topics in a novel, interesting and thoughtful manner.

Practitioners Take Note: Don't Get Bitten by the Federal Tort Claims Act (10/15/2020)

The Federal Tort Claims Act is the way that the federal government is sued for negligence. There are many exceptions to the Act and a complex framework with respect to when an entity and its employees are deemed to be covered by the F.T.C.A. The law has also evolved dramatically as to when certain organizations, especially medical health care entities, receive protection under the Federal Tort Claims Act. Contributory negligence is different than most state law. Parts of the FTCA borrow state law, and for some issues “federal law” governs. The SOL, particularly in minor’s tolling, is unique. Who gets sued, who gets served and exhaustion cannot be ignored? This seminar will deal with the major issues concerning the Federal Tort Claims Act, including how one deals with it and how one can be bitten by the Act.

Ethics-Attorney Client Privilege for In-House Counsel (02/12/2019)

Wrongful Death Before Birth (09/17/2019)

This presentation will review the circumstances under which an unborn fetus might assert a claim for wrongful death due to medical negligence. Not surprisingly, whether and when a fetus can legally assert a wrongful death claim differs dramatically in different states. The presentation will discuss the varying thresholds for recognizing such a claim, the legal consequences of such thresholds, and how attorneys who defend these lawsuits might approach a claim for wrongful death before birth.
