The topic of harassment, and sexual harassment in particular, has become an increasing concern for employers – not only in regard to their own personal behavior but also regarding the overall reputation of their organization as a harassment-free workplace. The #MeToo movement has heightened awareness of gender and power issues. However, an unintended consequence of the #MeToo movement had been risk of segregation of women professionals, a phenomenon that ultimately can lead to the denial of advancement opportunities and pay disparity. The purpose of this webinar is to educate employers about the existence of discriminatory compensation practices in the workplace and to think strategically about legal compliance and pay equality. We will explore the ramifications of gender segregation in the #MeToo era, provide an overview of current pay equity laws, and offer practical advice on how to identify and address implicit bias that can lead to potential gender discrimination and pay equity litigation.

Kathie Caminiti is a partner in the firm's New Jersey and New York offices, and a co-chair of both the Wage and Hour and Pay Equity practice groups. She has extensive experience handling all aspects of employment litigation, including individual plaintiff discrimination claims, restrictive covenant litigation and wage and hour class and collective actions. Kathie has a sophisticated wage and hour practice and has distinguished herself in Fair Labor Standards Act (FLSA)/wage and hour litigation. As lead counsel, Kathie has obtained favorable outcomes for clients in various wage and hour matters, including class and collective actions arising under the FLSA and various state laws. Kathie has successfully defended cases alleging civil rights violations, race, sex, age and handicap discrimination, sexual harassment, whistle-blowing, wrongful discharge and retaliation. She has also defended employers and financial institutions in Employee Retirement Income Security Act (ERISA) cases, including class actions, seeking severance, pension and health and welfare benefits. As a chair of Fisher Phillips’ Pay Equity Practice Group, Kathie dedicates her time to analyzing the legal issues surrounding pay equality, conducting pay equity audits and defending equal pay litigation. Kathie counsels her clients on compliance with the panoply of employment laws and assists with their liability prevention efforts by conducting employee training, preparing handbooks and implementing policies, as well as wage and hour and pay equity audits. Given her significant experience, Kathie is frequently quoted by ABC News, NJBiz, HR Executive, NJ 101.5 and other media outlets. She has published numerous articles that have appeared in The New York Law Journal, New Jersey Business, New Jersey Lawyer Magazine and Practical Law Institute regarding a variety of employment-related issues. |

Cheryl Pinarchick is a partner in the firm's Boston office and a founding Co-Chair of the Pay Equity Practice Group. She represents employers in all areas of employment law. Cheryl has extensive trial experience in state and federal courts throughout the United States. She has successfully defended employment lawsuits alleging wrongful termination, employment discrimination, sexual and other forms of harassment, wage and hour violations, retaliation and other related claims. She has also successfully prosecuted trade secret and non-competition agreements in numerous jurisdictions. Cheryl counsels employers on compliance with the law in areas such as pay equity, employment discrimination, wrongful termination, reductions in force, FMLA and leave laws, sexual harassment, and wage & hour matters, including issues related to employee classification. Cheryl also assists employers in their liability prevention efforts by conducting employee training, preparing handbooks and implementing policies, as well as conducting wage and hour and pay equity audits. With the patchwork of emerging state and local pay equity laws, Cheryl has been dedicating significant time to the legal issues surrounding pay equality, state pay equity legislation and litigation and pay equity compliance audits.
