How does the lawyer square his obligations under both state and PTO rules of professional conduct with the economic realities of an alternative fee? Christopher May and Christina Ondrick of McDermott Will & Emery LLP examine some of the ethical problems and issues that can arise when attorneys agree to take an intellectual property case using contingency fee agreements, blended agreements, partial ownership of the patent, and others.

Christopher L. May, Esq. is an associate in the law firm of McDermott Will & Emery LLP, based in its Washington, D.C. office. A member of the Intellectual Property, Media & Technology Department, he focuses his practice on patent and trademark litigation. Mr. May, who is also an adjunct professor at Michigan State University where he teaches a course on general intellectual property, earned his J.D. in 2001 from the University of Chicago Law School; his M.B.A., with a concentration in entrepreneurship, from the University of Chicago Graduate School of Business; his M.S. in chemistry from the Massachusetts Institute of Technology; and his B.S. in chemistry, cum laude, from Duke University.

Christina A. Ondrick, Esq. is an associate in the law firm of McDermott Will & Emery LLP, based in its Washington, D.C. office. A member of the Intellectual Property, Media & Technology Department, she focuses her practice on litigation and counseling relating to intellectual property, including patent, copyright, trademark, trade secret, unfair competition and antitrust matters. Ms. Ondrick, who is a registered patent attorney with experience in patent prosecution, reexaminations and interferences before the U.S. Patent and Trademark Office, was previously an oil, gas and petroleum engineer.
